The Post Municipal Court is the judicial branch of the City of Post. It is committed to administering justice in a fair, efficient and timely manner.
Municipal Court Jurisdiction
The Court has jurisdiction over the following types of cases within the City limits:
Class C fine-only offenses (traffic offenses and criminal offenses)
Municipal Ordinance Violations
Animal Control Violations
Appearances & Responses
All citations and summonses are assigned a deadline to appear in court. This date is by which a defendant (or their attorney) must notify the Court of how they wish to answer to their charges. Appearances may be made in person or by mail. Telephone calls do not constitute an appearance.
Youth Diversion Plan
The Texas Legislature passed H.B. 3186 in 2023 to better identify at-risk youth and redirect children accused of minor misdemeanors away from the criminal justice system. Currently, judges can only offer diversion programs after a conviction, which only prevents a criminal record. H.B. 3186 allows these programs to be used earlier in the process, improving their effectiveness. This change aligns municipal and justice courts with juvenile probation practices. If warrants have been issued for your arrest, you may contact the Court for the amount owed. If the warrants were issued for "Failure to Appear," you will need to come to the court or request in writing any other information regarding the warrants. If your citations have been placed in warrants for lack of payment, the total amount owed is due. You may contact the court by calling 806-990-3108, Monday-Thursday, 9:00 a.m. - 4:00 p.m. and Friday 9:00 a.m. - 12:00 p.m.

Arrest warrants issued out of the Post Municipal Court are addressed to any peace officer of the State of Texas. With active arrest warrants, you may be arrested at any time at your home, your place of business, or while operating a motor vehicle. You must contact the court and/or comply with court orders by the deadline given in order to avoid an arrest warrant being issued. Additional fees and costs will be assessed against you.
Fail to Appear Charge
If you fail to appear or make arrangements on a citation/charge in the Municipal Court, a “Fail to Appear” charge will be filed against you, in addition to the original charge(s).
Warrants
Once the fail to appear charge has been filed, a warrant for your arrest will be issued. The court will also issue an arrest warrant if you fail to:
Comply with the orders of the judge
Complete a payment plan or make payments as promised
TX DPS / Omnibase
A Notice will be sent to the Texas Department of Public Safety to flag your driver’s license for non-renewal.
Collections Agency
After 60 days, unpaid cases are sent to MVBA, McCreary Veselka Bragg & Allen P.C. for collections.

Once you have made a plea to each violation, you can then pay your fines. When you plead No Contest or Guilty to violations charged against you, you are waiving your right to a jury trial and you must make the full payment of your fines. However, the court may grant you additional time to pay the amounts due. You may appear in person to make that request or you can use the 31 Day Extension Request form(PDF) to make your request by mail.
Traffic Offenses
Notice: Drivers who are convicted of four or more moving traffic violations within a 12-month period, or seven or more moving traffic violations within a 24-month period, may have their driver license suspended by the Texas Department of Public Safety. Acceptable methods of payment include:

A minimum processing fee of 3.5% will be charged on all credit/debit cards.
Only full payments, payments on previously approved extensions or payment plans, may be paid online.
Pay in Person - You must bring valid proof of identification. The court accepts:
Cash, Credit / Debit cards (processing fee applies), Cashier’s Checks, and Money orders. Personal checks are not accepted.

If you are a juvenile, 16 years of age or younger, you must appear before the Judge in person with your parent or guardian. You must call the court on or before the appearance date on your citation to schedule a time to speak with the judge. Juveniles who fail to appear or who fail to pay their fine will be reported to the Texas Department of Public Safety who will suspend their driver's license. If they do not have a driver's license, they will not be able to obtain one until they appear in Court.
Address Notification
You and your parent are required by law to provide the Court, in writing, your current address and residence. If your place of residence changes, you have 7 days to notify the Court, in writing, of your new address and residence. Failure to keep the Court informed of your new residence may result in Failure to Notify charges filed against both you and your parent or guardian. The obligation of keeping the Court informed of your current address and residence is required until your case is finalized.

At their first appearance, a defendant (or their attorney) may request the following:
Acquittal of Insurance Offense
The violation may be dismissed, if sufficient proof of a valid insurance policy on the date and at the time of the citation, is presented to the court on or before the appearance date.
Administrative Dismissals
The following can be requested for administrative dismissal if the defendant remedies the offense in a timely manner. The following lists the most common offenses, please call the court for more information.
Defective Equipment or in Unsafe Condition
Requires proof of remedied defect by first court appearance date and a $10 required fee. (Does not apply if the offense involves a commercial motor vehicle.)
Section 547.004(c), Transportation Code
Expired Driver License
If expired less than 30 days, requires proof of license renewal by deadline and a $20 required fee. (Deadline is within 20 working days after the date of offense or before the defendant’s first court appearance, whichever is later.)
Section 521.026(a), Transportation Code
Expired Vehicle Registration
If expired less than 30 days, requires proof of registration renewal; including late registration penalty fee to county assessor-collector by deadline and a $20 fee. (Deadline is within 20 working days after the date of offense or before the defendant’s first court appearance, whichever is later.)
Section 502.407(b), Transportation Code
Operate Motor Vehicle Without License Plates or With One Plate
Requires proof that registration was current on the date/time of violation, both plates must be on the vehicle when you come to court and registration must identify the same vehicle as listed on the citation. Proof must be presented by first court appearance date and a $10 required fee.

Fail to Report Change of Name / Address
Requires proof that the driver’s license was updated by the deadline and a $20 required fee. (Deadline is within 20 working days after the date of the offense.)

Driving Safety Course Dismissal
Eligibility
You may be eligible to attend a driving safety course or a motorcycle safety course (if you were operating a motorcycle at the time of the citation) for dismissal of one moving traffic violation. You must meet the following requirements:
Have a valid Texas driver’s license that is not a commercial driver’s license or be active duty military personnel including spouses and dependent children.
Have valid proof of insurance or other evidence of financial responsibility.
Have not taken a Driving Safety Course within the past year to have a citation dismissed.
The violation was not committed in a construction zone when workers were present.
Cannot be speeding 25 miles per hour or more over the posted speed limit.
Cannot be speeding 95 miles or more.
Cannot be a violation for have overtaken or passing a school bus.
Cannot be a violation for failing to stop and provide information or render aid after an accident.
Cannot be charged with committing a serious traffic violation.
Note: Commercial Driver’s License Holders are Not Eligible
Driving Safety Course Requests (In Person or by Mail Only)
If you meet the above criteria, you may request a driving safety course on or before your appearance date on your citation. If you are sending your request by mail, then it must be postmarked no later than the appearance date on your citation. When you make your request, you must provide the court the following requirements:
A copy of your valid driver’s license
A copy of your valid insurance for vehicle listed on citation
Payment of court costs plus an administrative fee ($144.00 outside of a school zone or $169.00 inside of a school zone)

A notarized affidavit stating you are not presently taking, nor have previously taken within the last 12 months, a driving safety course. View the DSC Affidavit (PDF).
Late or incomplete requests will be rejected. Requests that are approved will be mailed an instruction packet to the address indicated on the DSC request form. Court approval must be obtained before beginning the driver safety course. You may take the course online or in a classroom. View a complete list of approved driver safety courses click here. You will be given 90 days to complete and return the driver’s safety course “Court” copy of certificate and your certified driver record to the court. To request your Certified Driving Record 3A, visit texas.gov or view the application (please allow 2-3 weeks for delivery). If you would like the court to send you a copy of the dismissal, please send a self-addressed stamped envelope.
Note: It is important to keep the Court notified of your current mailing address so you do not miss important correspondence.Failure to Comply
If you fail to present to this court, your proof of a uniformed certificate of a driving safety course and a certified driving record within the 90 days, the court will require your appearance at a show cause hearing. The show cause hearing notice will be mailed to you at the last known address the court has on file, or you may pay the balance owed, which will then result as a conviction on your driving record.
If you fail to appear at the show cause hearing, the court will impose the fine, enter a conviction and a capias pro-fine warrant will be issued for your arrest without further notice.
Deferred Disposition (Informal Probation)
The court offers the option to “defer” or postpone the disposition of your case and place you on probation (informal through the court) for a specified period of time. With a plea of no contest or guilty, you may request that you be granted a deferred disposition dismissal if you are not currently on probation for another violation. During the deferral period, you must comply with the terms and conditions of your deferral. You must pay the fine and court costs in addition to a special expense fee and you can not receive any citations/convictions in the State during your deferral period. Terms do vary.
Offense Categories
Offense categories that may be eligible for deferral include:
Moving Violations- If you were under 25 years of age at the time of the offense, you must complete a driving safety course and present the certificate to the court before the end of your deferral period.
If you were under 18 years of age at the time of the offense, you must complete a driving safety course, re-take the DPS driving test and present the certificate and test results to the court before the end of your deferral period.
No Insurance Violation - Your request must be accompanied with proof of valid liability insurance. You will be required to maintain your liablity insurance coverage throughout the deferral period and at the end, the clerk will verify the coverage was valid through the insurance company.
Eligibility
You are not eligible for a deferred disposition on a moving violation if you are charged with:
Leaving the scene of a collision
Passing a school bus
Speeding 25 miles or more over the posted speed limit
Any traffic violation that occurred while driving in a construction zone while workers were present
Have a commercial driver license even if the violation occurred while you were driving a private vehicle
Deferred Disposition Requests
You may only apply in person or by mail only.
If you meet the above criteria, you may request deferred disposition on or before your appearance date on your citation. If you are sending your request by mail, then it must be postmarked no later than the appearance date on your citation. When you make your request, you must provide the court the following requirements:
Completed Deferred Disposition Request form (PDF)
A copy of your valid driver license
Current proof of insurance (for insurance violations only)
Cashier’s check or money order made payable to Post Municipal Court (Call the court for deferral amount)
If you successfully comply with the terms of your deferral in the timeframe ordered by the court, your case will be dismissed. If any requirements are not met and you cannot provide a satisfactory reason why, at a hearing before the judge, you may be found guilty. If your offense is reportable to the Department of Public Safety (DPS), the court will provide notice of conviction to DPS. The judge has discretion of whether or not to grant deferred disposition.

When you receive a citation, you must enter a plea on the charge. The plea you enter is very important so please consider each plea before making a decision. You may enter your plea in person or by mail.
Nolo Contendere (No Contest) Plea
A plea of nolo contendere (no contest) means that you do not contest the charges against you and you are waiving your right to a trial by judge or jury. A plea of nolo contendere cannot be used against you in the event of a subsequent civil suit for damages (i.e., traffic accident for which you are subsequently sued).
Guilty Plea
A plea of guilty means that you admit you committed the charged offense and you are waiving your right to a trial by judge or jury.
Not Guilty Plea
A plea of not guilty means you are informing the Court that you are not guilty or have a good defense for your case. You must enter not guilty by the appearance date located on the bottom of the your citation. You must inform the Court whether you want a trial by judge or jury. Upon receipt of your plea, your case will be scheduled on the pretrial docket. At this docket, you will be able to speak with the prosecutor who will discuss with you the nature of your case. You will be required to appear in person or by attorney.

Yes. Defendants who are not contesting their citation can pay their fines with a credit / debit card online. A minimum convenience fee of 3.5% will apply. You may make partial payments online only if you have an approved payment plan in place with the court. No, you cannot take care of your husband’s/wife’s ticket. Only the person who received the citation or their attorney may enter a plea.
However, once a plea has been entered and arrangements have been made, anyone may make the payments.
